Are no KYC crypto cards legal?

Updated , 5 min read

Short answer: in most countries it is legal to hold and use a prepaid card, and the compliance burden sits with the issuer, not you. The details matter, so here is how it works.

This is general information, not legal advice. Rules differ by country and change often, so check the rules where you live.

Why issuers can offer cards without ID

KYC (know your customer) obligations apply to the company issuing the card. Many anti money laundering regimes allow simplified checks for low value prepaid products: a card with low limits and no cash withdrawals carries less risk, so the issuer may verify less. Other no KYC cards are issued from jurisdictions with lighter rules, or sit on top of a corporate card program where the company, not each user, is the verified customer.

That is why most no KYC cards are virtual, have spending limits, and may ask for ID once you go above a threshold. See what KYC means in crypto for the different verification levels.

Is it legal for you to use one?

In most countries there is no law against holding or using a prepaid card that did not ask for your ID. What is illegal is what has always been illegal: using any card to launder money, evade sanctions or buy prohibited goods. Some issuers also forbid users from certain countries in their terms. Using the card from there breaks your contract with the issuer, and they can freeze the balance.

Europe and MiCA

The EU's MiCA regulation and its anti money laundering package push EU licensed crypto companies towards full customer verification. Cards issued by EU licensed firms are therefore almost all KYC based. No KYC cards available in Europe are typically issued outside the EU. Our Europe page lists what is currently open to EU residents.

The United States

Many offshore issuers block US residents entirely to avoid US regulation, so the choice is narrower. See no KYC cards in the US.

Taxes still apply

In many countries, including the US, UK, Germany, Canada and Australia, spending crypto counts as selling it. If the coin has gained value since you bought it, the gain may be taxable. Topping up with stablecoins avoids most of this, because their value does not change. Keep your own records: no KYC issuers do not send tax statements.

Frequently asked questions

Is it illegal to use a crypto card without KYC?

In most countries, no. Using a prepaid card is legal for the cardholder. KYC rules apply to the issuer, which decides how much verification it needs under the rules of the country it operates from.

Do I have to pay tax when I spend crypto with a card?

Often yes. In many countries spending crypto counts as selling it, so a gain since you bought it can be taxable. Not needing ID to open the card does not change your tax obligations.

Will no KYC cards be banned in the EU?

MiCA and the EU anti money laundering rules push EU licensed issuers towards full verification. Cards issued outside the EU can still be used by EU residents, but availability can change, so keep balances small.
